JUDGMENT / ORDER

The petitioner was aggrieved with the issuance of 500 auto rickshaw permits to ply inside the Kozhikode city as “night city autorickshaw” ordered by Ext.P2. The contention is that there is a notification restricting the number of permits to be granted within the city limit of Kozhikode which as per Ext.P1 is fixed at 4100 under Section 74(3) of the Motor Vehicles Act, 1989. The writ petition itself was filed in the year 2013, it is not clear as to whether at present there are sufficient number of autorickshaws plying within the city to invite the rigor of Ext.P1. In any event, there was an interim stay of Ext.P2. The same would be made absolute. However, the RTA would be entitled to consider in accordance with law whether any additional permits are to be given within the city of Kozhikode, however subject to any notification issued under Section 74(3) of the M.V Act. Writ petition disposed of.
