JUDGMENT / ORDER

Petition under Section 438 Cr.P.C. 2. Petitioner is the accused in Crime No.803/2014 of the Chirayinkeezhu Police Station registered for the offences punishable under Sections 341, 294(b), 324, 427 and 308 IPC.
3. The allegation against the petitioner is that on 02.08.2014 at about 11 pm, out of previous enmity, the petitioner waylaid the defacto complainant, who was riding on a motor bike. He was abused, kicked down and repeatedly hit on his forehead and scalp with a stone, thereby causing serious injuries. The motor bike was also damaged to the tune of ₹5,000/-.
4. Heard learned counsel for the petitioner and learned Public Prosecutor.
5. The allegations against the petitioner are very grave BA No.7265/2014 : 2 :
and serious. The contents of the CD prima facie reveal the complicity of the petitioner. It has been reported that the petitioner is involved in two other criminal cases involving offences under Section 324 and 326 IPC. Considering the seriousness of the allegations against the petitioner, the criminal antecedents on his part, and also the present stage of the investigation, I am satisfied that the petitioner is not entitled to the discretionary relief of anticipatory bail.
In the result, this bail application is dismissed.
