Petition under Section 438 Cr.P.C. 2. Petitioners are accused in Crime No.398/2014 of the Padinjarethara Police Station, registered for the offences punishable under Sections 341, 342, 294(b), 353, 332, 225B, and 506(i) read with Section 34 of the Indian Penal Code.

A non bailable warrant for arrest of the 2nd petitioner was issued by the Judicial First Class Magistrate I, Perumbavoor and the warrant was issued to the Sub Inspector of Police, Mananthavadi Police. When the police officers attached to the Mananthavadi Police Station went to the house of the 2nd accused at 10.30 p.m on 11.11.2014 for the execution of the warrant, it is alleged that, they were wrongfully restrained, abused and attacked by the petitioners. They were criminally intimidated when the police officers attempted to take away the 2nd petitioner who is the accused B.A.No.8472 of 2014 2 against whom non-bailable warrant is pending, the other petitioners forcibly dragged the 2nd petitioner into the house. By the time when the presence of Padinjarethara police was obtained, the petitioners escaped from the house through the rear door.
4. Heard the learned senior counsel appearing for the petitioners and the learned Public Prosecutor. The contents of the C.D. prima facie reveal the complicity of the petitioners. This is not a fit case wherein anticipatory bail can be granted to the petitioners. The allegations against the petitioners are very serious as they had obstructed the police officers who reached for execution of warrant as per orders of the Court. Considering the seriousness of the allegations against the petitioners, I am of the view that this is not a fit case wherein anticipatory bail can be granted.
In the result, this bail application is dismissed.
