(Per : HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA) Though a sum of Rs.2,83,000/- approximately was due against the respondent - original petitioner - consumer, the learned Single Judge having directed to grant reconnection of electricity, this appeal has been preferred by the electricity company.
2. One Civil Application has been filed by the consumer-original petitioner, who submits that dues of previous owner amounting to Rs.69,884.20 ps. has been deposited with the electricity company. A prayer has been made to allow the respondent - original petitioner - consumer to deposit rest of the amount with interest i.e. Rs.2,21,000/- in 12 equal monthly installments.
3. Learned counsel appearing on behalf of the electricity company while requested to dispose of the appeal on such submission, submitted that lesser time should be allowed for depositing the amount.
4. Having heard the learned counsel for the parties, in the interest of justice, the following order is passed:-
(i) The consumer is allowed time till 30th November, 2010 to deposit a sum of Rs.80,000/-, another sum of Rs.50,000/- by 31st December, 2010 and rest of the amount of Rs.91,000/- by 31st March, 2011.
(ii) If the consumer deposits the 1st installment of Rs.80,000/- along with requisite amount for reconnection, the appellant - electricity company will grant electrical connection within 2 days' (i.e. 48 hours).
5. The order dated 8th May, 2009 passed by the learned Single Judge in Special Civil Application No.12992 of 2008 stands modified to the extent above. The Letters Patent Appeal and Civil Applications, both stand disposed of. Direct service is permitted.
