Petitioners were employed in U.P. Industrial Cooperative Association Ltd., Kanpur. They claim to have worked for different periods and some of them have subsequently taken voluntary retirement also. Their grievance is with regard to denial of salary for several months, in respect of which repeated representations have been made but no decision has been taken.
Sri S.P. Sharma, appearing for the respondent no.3 states that due to non-availability of resources payments have not been made. It is also stated that correspondence is going on with the State Government for allowing the society to dispose of some of its assets.
Be that as it may, once the petitioners' working is admitted it is their right to receive salary. Petitioners' grievance in that regard is already pending before the Managing Director concerned.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon respondent no.3 to accord consideration to petitioners' claim, in accordance with law, by passing an appropriate order, within a period of three months from the date of presentation of a copy of this order. In the event any assistance is required from the State Government, the first respondent shall also ensure that necessary support/guidance is extended to respondent no.3, within a further period of three months, thereafter.
