In pursuance of the order dated 21.10.2009 respondent no. 2 Vinod Kumar is not present but applicant Noorul Hasan @ Guddu and alleged victim Km. Aparna are present in the Court.
From the perusal of record, it appears that in this case charge sheet under Section 363/366 I.P.C. in case crime no. 123 of 2009 P.S. Nauchandi, District Meerut has been submitted in the Court concerned, the same is pending in the Court of learned 4th ACJM, Meerut in criminal case no. 9519 of 2009. It also appears that the statement of the alleged kidnapped girl has not been recorded by the I.O. and without recovery the charge sheet has been submitted. Therefore, it is directed that Km. Aparna shall appear before the Court of learned 4th ACJM, Meerut within 15 days from today, she shall move an application regarding her statement under Section 164 Cr.P.C. on which the learned magistrate shall fix the date, on that date opposite party no. 2 Vinod Kumar, the first informant of this case is summoned along with the I.O. of this case who shall identify the victim Km. Aparna after her identification her statement shall be recorded under Section 164 Cr.P.C. and she shall be medically examined by C.M.O. Meerut after recording her statement, it shall be forwarded to this Court along with medical examination report on or before 15th March, 2010.
List on 15th March, 2010. Till then interim order dated 21.10.2009 is extended.
