Shri M.D. Pandya, learned advocate waives service of notice of rule on behalf of the opponent.
The present application has been preferred by the applicant-original petitioner to restore Special Civil Application No. 10692/2004, which came to be dismissed for non-prosecution by this Court vide order dated 28/09/2010.
As the application is not opposed by Shri M.D. Pandya, learned advocate appearing on behalf of the opponent and even otherwise considering the averments made in the application, the present application is allowed and Special Civil Application No. 10692/2004 is hereby ordered to be restored to file. Rule is made absolute accordingly. No cost.
