It has been stated in the writ petition that the impugned order dated 14.10.2019 passed by the District Inspector of Schools, Gorakhpur has already been quashed by this Court vide its order dated 22.11.2019 passed in Writ - A No. 18121 of 2019 at the instance of Renoo Chaudhary one of the selected candidates recommended by the Committee of Management for appointment to the Institution and the matter has been remanded back to the District Inspector of Schools, Gorakhpur to decide the representation of the petitioner in the said case by a reasoned and speaking order in terms of the decision rendered in Sushil Kumar Yadav & Anr. Vs. State of U.P. & 3 Ors. (Writ - A No. 48244 of 2017). The said fact has been admitted by Anil Kumar Singh, Advocate representing respondent no. 3.
In view of the aforesaid, this writ petition is disposed of in terms of the order dated 22.11.2019 passed by this Court in Writ - A No. 18121 of 2019 and the District Inspector of Schools, Gorakhpur is directed to consider and decide the representation of the petitioner by a reasoned and speaking order in terms of the decision rendered in Sushil Kumar Yadav (supra) expeditiously, preferably within four weeks from the date of filing of certified copy of this order.
It is clarified that this Court has not expressed any opinion on the merits of the claim as raised by the petitioner in the present writ petition.
