JUDGMENT / ORDER

The petitioner claims to be a holder of building permit for constructing commercial building. The basement floor has to be constructed to a depth of 1.20m from the land level. The construction of the basement may results in the removal of earth from the beneath of land. This is consequent upon the permit granted to the petitioner. Therefore, it does not require a separate permit from the Geologist. However, for the purpose of transporting earth, 'P Forms” shall be obtained by the petitioner. 2. In these circumstances, Geologist shall conduct a site inspection in respect of the site covered by the permit issued by the local authority. On being satisfied that earth has to be extracted for the purpose of construction, necessary 'P Forms' shall be issued to the petitioner. The Geologist shall ascertain the quantity of the earth to be removed for the purpose of construction before issuing 'P Forms'.

3. District Geologist is not a party to the proceedings.
Hence District Geologist is suo moto impleaded as additional 7th respondent.
Needful shall be done within a period of three weeks from the date of receipt of a copy of this judgment.
