Heard Miss Afshan Shafaut, learned counsel for the petitioner.
The petitioner has filed a representation dated 26.11.2018 before the District Magistrate, Siddharthnagar, respondent No.2, requesting for recording certain land as Kabristan in the revenue records.
I do not find any good reason to entertain the writ petition for the reason that if the petitioner has any right for recording of Kabristan, in the Revenue records over certain plots of land then he should have filed an appropriate application/suit before the competent authority/court along with copies of relevant papers. It is further relevant to mention that the petitioner had earlier filed P.I.L. No.45498 of 2015 (Noor Mohammad v. State of U.P. and others), which was disposed of by a Division Bench of this Court by order dated 13.8.2015, leaving it open to the petitioner to move an appropriate application before the concerned respondent for remedial action for construction of boundary wall.
In view of the aforesaid, I do not find any good reason to entertain this petition. Consequently, the writ petition is dismissed, leaving it open to the petitioner to take an appropriate action as may be available to him under law.
