Heard learned counsel for the applicants and learned A.G.A. on behalf of State.
The present 482 Cr.P.C. application has been filed to quash the charge sheet dated 10.12.2013 as well as the entire proceedings of Case No.455/9 of 2018 (State Vs. Noor Mohammad and others) under Sections 323, 504, 506 IPC, P.S. Ratanpuri, District Muzaffar Nagar, pending in the Court of Judicial Magistrate-Ist Muzaffar Nagar.
Learned counsel for the applicants states that charge sheet could not have been submitted and the learned Magistrate could not have taken cognizance on the same treating it to be as a State Case. However, the offence alleged under Section 506 IPC against the applicants is cognizable in view of the U.P. Amendment.
The application lacks merit and is, accordingly, dismissed.
