Heard learned counsel for the applicant, learned Additional Government Advocate for the State/opposite party no.1 and perused the record with the assistance of learned counsel for the parties.
This application under Section 482 Cr.P.C. has been filed by the applicant for a direction to the court below to conclude the proceedings of Matrimonial Case No. 170 of 2021 (Noor Mohammad vs Smt. Mahelka), under section 281 of Muslim Marriage Act, pending in the court of Principal Judge, Family Court, Maharajganj, as expeditiously as possible.
At the very outset learned counsel for the applicant submitted that he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to file afresh at the appropriate stage.
In view of statement made at bar by Mr. Pramod Kumar Maurya, learned counsel for the applicant, this application under section 482 Cr.P.C. is rejected as withdrawn with liberty to file afresh at the appropriate stage.
Office is directed to return the certified copy, if any, to the learned counsel for the applicant after retaining photostat copy of the same on record as per rules.
