Heard learned counsel for the petitioner and learned Standing Counsel for the State.
By way of this writ petition, the petitioner has prayed the following prayers:-
"(i) issue a writ, order or direction, in the nature of mandamus commanding and directing to the respondents to grant the land on lease in favour of the petitioner in respect of the Enemy Property situated at Mohalla Jahageerpur Budha Safaid Pargana and Tehsil Nagina, District Bijnor.
(ii) issue a writ, order or direction in the nature of mandamus commanding and directing to the District Magistrate Bijnor/Respondent No.3 to execute the lease in respect of the land in question i.e. plot Nos. 4, 7, 8, 8/2, 10, 14, 15, 16, 17, 18, 18, 19, 23, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48 and 121 (Total 36 plots) situated at Village Jahangeerpur Budha Safaid pargana and Tehsil Nagina, District Bijnor."
It is submitted that petitioner has made an application before the authorities concerned for seeking lease in favour of petitioner in respect of the Enemy Property Act, 1968.
Accordingly, the writ petition is disposed of with a direction to the respondent-authorities concerned to go into the merits of the matter and decide the same on or before 31.10.2021 by a reasoned order.
This Court has not expressed any opinion on the merits of the case.
