Heard learned counsel for the applicant and learned AGA for the State.
The applicant in is jail since 16.05.2010 in connection with an offence under Section 18/20 N.D.P.S. Act. 500 Grams of Charas is alleged to be recovered from possession of the applicant, which is less than the commercial quantity. According to learned A.G.A., there is no criminal history of the applicant.
Taking into consideration to the facts and circumstances of the case and without expressing any opinion on merits, bail application is allowed.
Let the applicant Noor Hasan alias Baraka son of Mohd. Ali involved in case crime no. 172 of 2010, under Section 18/20 N.D.P.S. Act, Police Station Rail Bazar, District Kanpur Nagar be released on bail on executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
