Heard learned counsel for petitioner and perused the record.
The present petition has been filed by petitioner seeking direction to court below to decide the Case No.1590 of 2001 (Manjoor Ahmad Vs. Abdul Avval & others) pending in the court of Additional Civil Judge (J.D.), Court No.17, Azamgarh within a stipulated period.
It is submitted by learned counsel for petitioner that suit filed by petitioner is pending since 2001 and on account of delaying tactics adopted by opposite parties the case could not be proceeded.
Considering the facts and circumstances of the case and without commenting on the merits of the case, learned Additional Civil Judge (J.D.), Court No.17, Azamgarh is directed to decide Case No.1590 of 2001 (Manjoor Ahmad Vs. Abdul Avval & others), preferably within a period of one year from the date of production of certified copy of this order, unless there is any legal impediment.
With the aforesaid directions, the petition is disposed of.
