Noor Ahmad & Anr. vs State Of U.P.Thru.Prin.Secy. ...

High Court Of Judicature at Allahabad|11 May, 2021

JUDGMENT / ORDER

Hon'ble Manish Mathur,J.
Case is taken up through video conferencing.
Heard learned counsel for petitioners as well as learned A.G.A. for the opposite parties.
Learned counsel for petitioners submits that petitioners No. 1 and 2 have entered into a wedlock out of their free will. They both are major. No criminal case has been lodged against them till date, however the police is harassing the petitioners as petitioner No.1 and petitioner No.2 belong to different sects.
Learned A.G.A. appearing for opposite parties submits that it will have to be verified as to whether the police is harassing the petitioners in any manner or not and whether any criminal case has been lodged against the petitioners. It is also submitted that petitioners No.1 and 2 belong to different religions and as such the provisions of the Uttar Pradesh Prohibition of Unlawful Religious Conversion Ordinance, 2020 would be attracted which is fully enforceable.
Be that as it may, we are of the view that in case no criminal case has been lodged against the petitioners and petitioners are major in age, they shall not be harassed by any one.
The writ petition is accordingly disposed of with the observation that in case no criminal case has been lodged or pending against the petitioners, they shall not be harassed by any authority or person.
