This petition has been filed by the petitioners Nokhey Lal Yadav S/O Ayodhya Prasad & Ors. with a prayer to quash the FIR of case crime No. 122 of 2011 under sections 419, 420, 467, 468, 469, 471, 196, 197 IPC, P.S. Maheshganj, District Pratapgarh.
From the perusal of the FIR it appears that on the basis of allegation made therein the prima facie cognizable offence is made out. There is no scope of interfering in the FIR. Therefore, the prayer for quashing the FIR is refused.
The interim order dated 13.6.2011 is hereby vacated.
Considering the facts it is directed that in case the petitioners have not appeared before the court concerned or not arrested by the police, they shall appear before the court of learned Magistrate concerned within 30 days from today and apply for bail, the same shall be heard and disposed of expeditiously if possible on the same day by the courts below.
With this direction, this petition is finally disposed of.
