Heard the learned counsel appearing for the petitioner and Mr.T.N.Rajagopalan, learned Special Government Pleader for respondents 1 to 3 and 5 and Mr.A.Nagarajan, learned counsel for respondents 4 and 7, who take notice on behalf of their respective parties.
2. The writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to constitute the Town Vending Committee in terms of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act 2014 identify the hawking zone formulate the Scheme register the members of the petitioner association whose names are given in the Annexure to the writ petition as Vendors and grant them license to hawk in South Usman Road (From Mustafa Gold Mart to Nalli 100 Shop) and till then forbear the Respondents from preventing/evicting the members of the Petitioners Association from hawking in South Usman Road (From Mustafa Gold Mart to Nalli 100 Shop) in any manner.
3. It is for the respondents to consider the representation of the petitioner and constitute a Vending Committee and in turn it is for the Vending Committee to identify place for the hawkers and form a scheme, within a period of three months from the date of receipt of a copy of this order. Till then, present position of the members of the petitioner need not be disturbed. The writ petition is disposed of accordingly. No costs. The connected miscellaneous petition is closed.
