The question of tenancy raised in O.S.No.571 of 1998 on the file of the Court of the Munsiff of Kochi was referred to the Land Tribunal, Tripunithura Ernakulam under Section 125(3) of the Kerala Land Reforms Act. The reference has been numbered as R.C.No.3 of 2001 on the file of the Land Tribunal and the same is being adjourned without rendering a finding and forwarding the same to the civil court. The petitioner who is the second plaintiff in the suit laments that the reference is being dragged before the Land Tribunal for the past over 10 years causing undue hardship to him.
2. I therefore direct the Land Tribunal, Tripunithura, Ernakulam to finalise the proceedings in R.C.No.3 of 2001 pending on its file and forward a finding to the Court of the Munsiff of Kochi at the earliest. The same shall be done within a period of three months from the date of receipt of a copy of this judgment.
The original petition is disposed of as above.
