This petition has been filed to call for the records and quash the proceedings in C.C.No.151 of 2010, on the file of the learned Judicial Magistrate No.III, Dindigul.
2. Heard the learned counsel for the petitioner, learned counsel for the second respondent and the learned Government Advocate (Crl. Side) for the State and perused the materials available on record.
3. The learned Government Advocate (Crl. Side) on instructions, would submit that the case in C.C.No.151 of 2010, on the file of the learned Judicial Magistrate No.III, Dindigul, has already been transferred and is now pending before the learned Chief Judicial Magistrate, Dindigul, as C.C.No.47 of 2016, and therefore the prayer sought for in this petition itself has become infructuous. It is also represented that the case in counter is pending as C.C.No.210 of 2010 before the learned Judicial Magistrate No.III, Dindigul.
4. In view of the submissions made by the learned Government Advocate (Crl. Side), this Criminal Original Petition is dismissed as infructuous. Consequently, connected miscellaneous petitions are closed. However, the learned Chief Judicial Magistrate, Dindigul, is directed to transfer the alleged case in counter, if any, pending before the learned Judicial Magistrate No.III, Dindigul, to his file and dispose of both the cases i.e., C.C.No.47 of 2016 on his file and the case in counter, pending before the learned Judicial Magistrate No.III, Dindigul, within a period of two months from the date of receipt of a copy of this order.
