JUDGMENT / ORDER

[1] On 12.08.1994, this Court has passed the following order:-
“Rule. To be heard with Special Civil Application Nos. 1977 of 1994 and 1979 of 1994.
Ad-interim relief in terms of para 22(c).
D.S. permitted.
[2] In identical matter Special Civil Application No. 1977 of 1994, this Court has passed the following order:-
1. By way of this petition the petitioner has prayed to quash and set aside the orders dated 14.5.1992 and 27.8.1993 and to declare that the reduction in pension to the minimum of Rs. 375/- P.M., is illegal and arbitrary.
2. The brief facts of the case are as under :-
2.1 As per the say of the petitioner the petitioner is a retired Executive Engineer. During the period of 31.7.1982 to 10.6.1984, three charges were leveled against him and his pension was reduced to minimum of Rs. 375/-.
2.2 A departmental inquiry was conducted against the petitioner and ultimately the Government in Narmada and Water Resources Department passed an order on 14.5.1992 to reduce the pension of the petitioner to the minimum of Rs. 375/-. Against this order, the petitioner has preferred an Appeal on 23.6.1992. The said appeal came to be rejected on 27.8.1993. Hence this petition.
3. Heard learned advocates for the respective parties and perused the documents on record.
4. While admitting this matter, on 11.02.1994 this Court has passed following order:
“Leave to amend. Rule. Ad- interim relief in terms of Para 20(a). D.S. Permitted.”
5. Thus by way of interim order the impugned orders were stayed. The matter is of the year 1994 and he must have been granted all the benefits. Therefore it would not be in the interest of justice to disturb the said position at this stage. Therefore this petition is disposed of in terms of interlocutory order. Rule is made absolute to the aforesaid extent with no order as to costs.
[3] In view of the above, the present petition stands disposed of.
