JUDGMENT / ORDER

The petitioners are aggrieved by Exhibit P9 order of supersession, made under Section 32 of the Kerala Co-operative Societies Act, 1969 [for brevity “the Act”]. A reading of the order would indicate that, there is no consultation as provided under Section 32 of the Act. 2. The issue is squarely covered by the decision of the Hon'ble Supreme Court in State of M.P. and Others v. Sanjay Nagayach and Others [2013 (2) KLT 733] and a Division Bench decision of this Court in State of Kerala v. Board of Directors of Urukunnu Service Co-op. Bank Ltd. [2013 (2) KHC 201].
3. In the above circumstance, the writ petition would W.P.(C) No.19797 of 2009 - T 2 stand allowed and Exhibit P9 would stand set aside. The Department would be reserved liberty to proceed in accordance with law. Parties are left to suffer their respective costs.
