JUDGMENT / ORDER

Heard the counsel for the petitioner and the Standing Counsel for the bank. The Standing Counsel raises a preliminary objection as regards the maintainability of the Original Petition. The bank points out that the petitioner is free to urge all his contentions in the Court below itself.
2. All that the petitioner prays is for easy instalments to pay the decree debt and to avert the execution sale in the meanwhile. I permit the petitioner to pay the amount due in eight equal monthly instalments starting from 01.07.2014.
3. The property proposed to be proclaimed shall not be sold if the petitioner complies with the conditions. The execution sale can go on if the petitioner commits default in the payment of any one of the instalments.
The Original Petition is disposed of.
