N.Janakiraman vs The Director Of Public Libraries

Madras High Court|22 December, 2017

JUDGMENT / ORDER

This writ petition has been filed seeking issuance of Writ of Mandamus to direct the respondent to consider and pass appropriate orders on the representation of the petitioner dated 03.03.2017.
2.Heard the learned counsel appearing for both sides and perused the materials placed on record.
3.Learned counsel appearing for the petitioner submitted that the petitioner who was appointed as Grade-III Librarian on 24.03.1970 was promoted as Grade-II Librarian on 01.08.1999 and subsequently, promoted as Grade-I Librarian on 14.05.2002. Since the inter se seniority among the librarians have not been streamlined, W.P.No.24947 of 2007 etc. batch was filed to rework the entire senority list. On the said Writ Petitions, this Court passed a common order on 08.04.2009 to rework the entire seniority list in the State of Tamil Nadu. The said common order was also challenged before the Hon'ble First Bench in W.A.No.1173 of 2010 etc. batch and the said appeals were disposed of on 20.09.2010 as follows :
"7. ... i] The appellant shall prepare a draft state wide seniority list of Librarian Gr.I/Inspector of Libraries within a period of two weeks from the date of receipt of a copy of this order.
ii] The appellant shall publish the draft state wide seniority list by bringing to the notice of all the Librarians/Inspector of Libraries and all other persons who may be aggrieved through the District Library Officers.
iii] The Librarians/Inspector of Libraries and other persons aggrieved shall submit their objections, if any to the draft seniority list within a period of two weeks from the date of publication of the draft seniority list.
iv] On receipt of these objections, the appellants shall consider the same and publish the final seniority list within a period of four weeks from the date of receipt of the objections from aggrieved persons.
8.With the above directions, these appeals are disposed of. No costs. Consequently, connected miscellaneous petiions are closed."
When the matter stands as above, the petitioner has come with a representation indicating some anomaly in his scale of pay vis-a-vis his junior Mr.M.Angamuthu's scale of pay. Since the said representation has not been considered till date, the petitioner is before this Court.
4.Mr.V.Jayaprakash Narayanan, learned Special Government Pleader, who took notice for the respondent sought eight weeks time to dispose of the representation submitted by the petitioner.
5.Recording the aforementioned submission made by the learned Special Government Pleader, this Court directs the respondent to consider the pending representation of the petitioner on merits and pass orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
The Writ Petition is disposed of accordingly. No costs.
