Heard learned counsel for the petitioners and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.1- Consolidation Officer (Final Record), Padrauna, District Kushi Nagar to decide the case no. 87+88 of 1982 within stipulated time.
The contention of learned counsel for the petitioners is that petitioners filed objection under Section 9A (2) of the U.P.C.H. Act, 1953, which was dismissed in default vide order dated 23.11.2016. Subsequently, the said order was recalled by the Consolidation Officer vide order dated 12.3.2018. Since then, objection filed by the petitioners is pending and no final decision has been taken.
Considering the facts and circumstances of the case, respondent no.1- Consolidation Officer (Final Record), Padrauna, District Kushi Nagar is directed to decide the case no. 87+88 of 1982 as expeditiously as possible preferably within a period of six months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
