Heard learned counsel for the petitioner and Sri Sunil Kumar Singh, learned counsel appearing for the Gaon Sabha as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with a prayer that the respondent no.3-Additional Collector (Finance & Revenue), District- Prayagraj be directed to decide the case no. D201202300630 (Nizam vs. Smt. Badrunnisha and others) under section 198(4) U.P. Z.A. & L.R. Act, 1950 pending before him, within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 3 to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of six months from the date of production of self-verified copy of this order, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties and provided the functioning of the Court concerned is not affected due to any reason related to COVID- 19 Pandemic as well as the lawyers are not abstaining from the judicial work.
With the aforesaid observations/ directions, the present petition is finally disposed of.
