1 By way of the present Revision Application under Section 29(2) of the Bombay Rent, Hotel and Lodging House Rates Control Act, 1947, the applicant - original plaintiff, has challenged the judgment and order dated 14.5.2010, passed by the learned Civil Judge, Thasara, in Regular Civil Suit No.30 of 2002, by which the suit filed by the plaintiff is dismissed as well as the judgment and order dated 27th June, 2012, passed by the 4th District Judge, Kheda at Nadiad in Regular Civil Appeal No. 31 of 2010, by which the appeal filed by the present applicant - original plaintiff is dismissed. It appears that the impugned judgment and orders are challenged by the applicant by way of filing the present Revision Application on 23.8.2012. The Revision Application was listed before this Court for the first time on Admission Board on 17.10.2012. Learned Advocate for the applicant requested for time and, therefore, the Page 1 of 2 C/CRA/238/2012 ORDER matter was adjourned to 2nd November, 2012. Again on 2.11.2012, learned Advocate, for the applicant did not remain present, however, the matter was adjourned today i.e. on 7.12.2012.
2 Today in the first session, the matter was called out twice, but learned Advocate appearing for the applicant did not remain present, therefore, the matter was kept in the second session. Even in the second session, learned Advocate for the applicant is not present. Hence, the matter is dismissed for non-prosecution.
