Heard Shri Ashok kumar Vimal, learned counsel for the petitioner and Shri Rajmani Yadav, learned counsel appearing for the respondents no. 2 and 3.
The petitioner says that his retiral dues have been paid to him and he is getting pension regularly but his gratuity has not been paid till date and the benefit of A.C.P. along with arrears have not been given to the petitioner. He has already made a representation on 13.07.2018 to the respondent no. 2 (Nagar Ayukt, Nagar Nigam, Allahabad) which is pending.
Learned counsel for the respondents has received instructions to the effect that gratuity and arrears of ACP etc. could not be paid to the petitioner due to financial crisis being faced by the Nagar Nigam. He says that in case some reasonable time is given to the respondents, it shall make rest of the payments also.
Accordingly, this writ petitions is disposed of with a direction to the respondent no. 2 to look into the grievance of the petitioner and pass reasoned and speaking order in accordance with law within three months from the date a certified copy of this order is produced before him.
In case certain dues are found admissible to be paid to the petitioner, the respondent no. 2 shall ensure payment within a further period of one month.
