JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to take treatment for his own self.
Along with the application, certificate issued by the Medical Officer, Central Jail Dispensary, Ahmedabad is also annexed where from we find that the applicant is suffering from skin disease and also the problem to his private parts.
Pursuant to the earlier order passed by this Court, learned APP, Shri Pandya, has submitted that the statement of the applicant-convict is taken and he is willing to furnish the surety of a person having immovable property of the value not less than Rs.25,000/- .
Fresh Medical Certificate dated 6.4.2012 is also produced which confirms that the ground mentioned in the application is genuine.
From jail remarks, we find that the applicant-convict is in jail since about 5 years.
Considering the totality of the facts, it is directed that the applicant-convict shall be enlarged on temporary bail for a period of 3 weeks from the date of his actual release on personal bond of Rs.5,000/- with one surety who is having immovable property worth not less than Rs.25,000/- and said surety shall produce the documents in support of his property to the jail authority which shall be returned to him after the applicant surrenders to the jail authority. It is also directed that the applicant surrenders to the jail authority upon expiry of the time granted by this Court.
Application allowed to the aforesaid extent. Rule made absolute.
This order shall be communicated to the jail authority by learned APP, Shri Pandya.
