Heard Sri Sushil Kumar Dubey, learned counsel for the applicant, learned A.G.A. Perused the record.
This bail application has been moved by the applicant Nitin who is involved in Case Crime No. 293 of 2008, under Section 3/7 Essential Commodities Act, Police Station-Janakpuri, District-Saharanpur.
As per prosecution version, it is alleged that the gas cylinder which is authorized for domestic use, applicant was using the same for business purpose.
Learned counsel for the applicant contended that applicant has been falsely implicated in the present case due to enmity and he is languishing in jail since 6.3.2018.
Learned A.G.A., has opposed the prayer for bail.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Nitin, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
