Sri Dhiraj Kumar Pandey, learned counsel for applicants, after arguing on the aspect of separate residence of applicant nos. 2 to 9, when asked to demonstrate from record and documentary evidence that applicant nos. 2 to 9 have separate residence, as pleaded by him in his affidavit, submits that he has no documentary proof in regard to separate residence.
In view of such fact, quashing of the case on the basis of separate residence, is not made out. Therefore, application is dismissed on merits, however, applicants are at liberty to move an appropriate application for anticipatory/regular bail, as the case may be, which shall be decided by the court concerned on its own merits.
