The grievance of the petitioner is that the case being Original Suit No.1053/2018 filed under section 9 of the Hindu Marriage Act was not being decided. It is the case of the petitioner that under the Hindu Marriage Act, it is provided that the case would be concluded within a specified period of time. It does not stand to reason that the case shall be adjourned on the mere asking of the parties.
Under such circumstances, the Original Suit No.1053/2018 be proceeded on a day to day basis. It is made clear that adjournment, sought by any of the parties, may be granted only after imposition of a minimum cost of Rs.2000/- on the person seeking adjournment.
With these observations, the writ petition is, accordingly, disposed of.
