Heard Sri Sharad Kumar Srivastva, learned counsel for the applicant and Sri Amrit Raj Chaurasia, learned A.G.A. for the State.
The applicant has prayed for anticipatory bail in the present case.
Learned counsel for the applicant submitted that the co-accused. Shri Prakash Agrawal has been allowed interim anticipatory bail in Criminal Misc. Bail Application No.31828 of 2019 by a co-ordinate Bench of this Court vide order dated 19.8.2019 and the same was posted first for 11.9.2019 and thereafter for 16.10.2019.
Issue notice to opposite party no. 2.
Learned A.G.A. shall seek instructions in the matter by the next date fixed.
Copy of Criminal Misc. Bail Application No.31828 of 2019 filed today by learned counsel for the applicant is taken on record.
Without expressing any opinion on the merits of the case and considering the nature of accusation and his antecedents, the applicant is entitled to be released on interim bail in this case.
In the event of arrest of the applicant Nitin Verma involved in Case Crime No.947 of 2015 under Sections 409 and 420 IPC, Police Station Firozabad South, District Firozabad he shall be released on interim bail in view of Section 438 (2) Cr.P.C. till the next date of listing on his furnishing a personal bond of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of the Station House Officer of the police station concerned with the following conditions.
(i) the applicant shall make himself available for interrogation by a police officer as and when required;
(ii) the applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police office;
(iii) the applicant shall not leave India without the previous permission of the Court and if he has a passport the same shall be deposited by him before the S.S.P./S.P. concerned.
In default of any of the conditions, the Investigating Officer is at liberty to file appropriate application for cancellation of interim bail granted to the applicant.
Let the present matter be also connected with the aforesaid Anticipatory Bail Application and list on 16.10.2019 on which date the Court after due consideration of the contentions of learned counsel for the parties may either confirm, modify or cancel the interim bail granted to the applicant.
The present matter shall not be treated as tied up or part heard to this Court.
