Heard learned counsel for the applicant and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicant, Nitin Mishra, with a prayer to release him on bail in Case Crime No.131 of 2019, under Sections- 411, 413, 414, 419, 420, 467,468,471,482 IPC, Police Station- Sarpataha District- Jaunpur during pendency of trial.
Applicant has earlier approached this court praying for quashing the entire proceedings in pursuance of the charge sheet dated 16.4.2020 and cognizance order dated 20.8.2020 by way of application U/S 482 No. 17800 of 2020, which has been dismissed by this court vide order dated 7.1.2021 on the ground of want of prosecution.
In view of paragraph 43 (8) of the judgement dated 05.04.2021 passed by this Court in Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No. 2110 of 2021, Shivam Vs. State of U.P. and Another, this anticipatory bail application deserves to be rejected.
It is accordingly, rejected.
