The petitioner claims consideration of his candidature for compassionate appointment on class III post pursuant to the Government Order dated 17.6.2014 i.e. commensurate to the qualification possessed by the petitioner.
Submission is that the petitioner has applied for grant of compassionate appointment on the death of his father on 4.8.2017. He has been appointed on 9.1.2018 on a class IV post. He has accepted the said assignment but is agitating his claim for a Group 'C' Post, which is lying vacant in the department-in- question. The claim of the petitioner having possessed the eligibility requirement for the said post, can be considered but the same has not been considered till date.
Only prayer made during the course of argument is to issue a direction to the competent authority, namely, respondent no.4 to a take decision in accordance with law.
To this submission, learned standing counsel raises no objection.
In view thereof, without expressing any opinion on the merits of the claim of the petitioner, the writ petitions is being disposed of with the direction to respondent no. 4 to take appropriate decision in accordance with the procedure for compassionate appointment provided under relevant rules and the Government Orders pertaining to the field.
