Order on Amendment Application No. 1 of 2019 Heard Sri Dharmendra Singh, learned counsel for the applicant and Sri Amit Sinha, learned A.G.A. for the respondent no. 1 on amendment application.
The amendment application is allowed.
Learned counsel for the applicant is permitted to carry out the necessary amendment in the Court itself.
Order on Writ Petition This application has been filed making prayer that the trial court be directed to expedite the proceedings in Criminal Case No. 11407 of 2017 (State Vs. Rajesh and others) arising out of Crime No. 266 of 2017 under Sections 420, 467, 468, 471 of IPC, P.S. Kotwali, District Bareilly.
Learned counsel for the applicant submits that in Application under Section 482 No. 2643 of 2018 in respect of co-accused, an order has been passed by this Court that no coercive steps shall be taken against the applicant and this order has wrongly been constituted by the Court where the court below has not proceeded with the case. It has been argued that even charge has not been framed till today, though charge sheet was filed on 7.8.2017.
On the other hand, learned A.G.A opposes the application.
The present application is disposed of directing the trial court to expedite the proceedings. In case of non cooperation by any of the accused, court below to take appropriate steps as permissible under the law.
