Heard learned counsel for the petitioner.
By means of this writ petition under Article 227 of the Constitution, the petitioner has prayed for a direction upon the Court of Small Causes/District Judge, District Meerut to decide and conclude the proceedings of SCC Suit No.35 of 2008 (M/s Vardhman Estate and another vs. Sardar Rajbir Singh and others), within a stipulated period as may be fixed by this Court.
Learned counsel for the petitioner has submitted that the petitioner is landlord and has filed SCC Suit before the court below for eviction and arrears of rent. He has further submitted that in the said suit pleadings are exchanged and the suit has now been fixed for final hearing, but the same has not been decided as yet.

Considering the facts and circumstances of the case and submission made, but without prejudice to the merits of the case, the present writ petition is disposed off with the direction to the Court of Small Causes/District Judge, District Meerut to decide and conclude the proceedings of SCC Suit No.35 of 2008 (M/s Vardhman Estate and another vs. Sardar Rajbir Singh and others), as expeditiously as possible, preferably within a period of four months from the date of submission of certified copy of this order, if there is no other legal impediment.
It is made clear that no unnecessary adjournment shall be granted by the court below and if the adjournment is taken by either of the parties, the court below shall impose heavy cost upon the parties.
