JUDGMENT / ORDER

Sri Prabhakar Awasthi, learned counsel files memo of appearance on behalf of the opposite party No. 2.
Heard learned counsel for the applicants, learned counsel for the opposite party No.2 and learned A.G.A. for the State.
The present 482 Cr.P.C. petition has been filed for quashing the complaint case No. 310 of 2010 (Rakesh Kumar Agrawal Vs. Saleem and others) under sections 63/65 Copyright Act and Sections 113,114 and 115(4) of Trade Marks Act, P.S. Banna Devi, District Aligarh and also quash the orders dated 14.1.2010 and 8.2.2010 passed by the C.J.M. Aligarh.
It is contended by the learned counsel for the applicants that the initiation of present criminal case is bad in law. It is further contended on behalf of the applicants that the matter is of civil nature.
Learned counsel for the opposite party No.2 prays for and is granted two weeks' time to file counter affidavit. Learned AGA may also file counter affidavit within the same period. As prayed by learned counsel for the applicants one week thereafter is granted for filing rejoinder affidavit. List this case on 13th July, 2010 before the appropriate Bench. Till the next date of listing, no coercive step shall be taken against the applicants.
