The petitioner's vehicle bearing registration number KL 11-AC-8210 has been seized alleging transportation of ordinary red earth without permit. The petitioner submits that the owner of the site is constructing a residential building based on the valid building permit. Since no permit is required for extracting the ordinary earth, petitioner's vehicle is liable to be released. 2. Considering the facts and circumstances of the case, there shall be a direction to the first respondent to release the petitioner's vehicle on executing a bond with two solvent sureties within three days from the date of receipt of a copy of this judgment. However, this will not stand in the way of the Authority in filing a complaint against the petitioner if the petitioner had violated any of the relevant Rules or Law.
The writ petition is disposed of as above.
