JUDGMENT / ORDER

Chief Justice's Court
Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1815 of 2019 Petitioner :- Nirmalya Welfare Society Respondent :- State Of U.P. And 8 Others Counsel for Petitioner :- In Person Counsel for Respondent :- C.S.C., M.C. Chaturvedi, Senior Advocate, assisted by Suresh C. Dwivedi Hon'ble Govind Mathur,Chief Justice Hon'ble Vivek Varma,J.
For the same cause, the petitioner preferred a Public Interest Litigation (PIL) No. 61423 of 2017 that came to be disposed of on 26.02.2018 in following terms:
"Mr. Satyendra Kumar Singh, learned counsel for the petitioners, does not press this writ petition and seeks liberty to the petitioners to approach the State Government with the reliefs as prayed in the present writ petition, by way of representation.
Petition is disposed of, with liberty as prayed.”
In compliance of the directions given on 26.02.2018, the petitioner submitted a representation to the Vice Chairman, Ghaziabad Development Authority, Ghaziabad on 09.03.2018, copy whereof is placed on record as Annexure No. 4. In the representation dated 09.03.2018, reference of the order passed in Public Interest Litigation (PIL) No. 61423 of 2017 is also given. A review application then was filed and that also came to be dismissed on 10.01.2019 by this Court.
Be that as it may, it is not in dispute that in compliance of the order passed by a Division Bench of this Court in Public Interest Litigation (PIL) No. 61423 of 2017, the petitioner submitted a representation to the Vice Chairman, Ghaziabad Development Authority, Ghaziabad.
After submitting the representation, we do not find any just reason to entertain this petition for writ for the same cause. The petitioner is required to agitate his representation that was submitted on 09.03.2018. It is also expected from the Authority concerned to whom this representation is submitted to consider and decide in accordance with law expeditiously.
The writ petition stands disposed of.
Order Date :- 27.9.2019/Shubham
