Heard learned counsel for the petitioner and Shri Anurag Srivastava, learned Standing Counsel.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioner is before this Court for a direction to respondent no.1 to take action against respondent nos.2 to 6 in pursuance of the order dated 28.2.2011 passed by Tehsildar Pindra, Varanasi under Section 49 Ka of UPZA & LR Act.
Learned counsel for the petitioner states that the aforesaid proceeding has been finalised against the private respondents way back on 28.2.2011 and at no point of time the said order has been assailed by them and as such for all practical purpose the same has attained finality and the order dated 28.2.2011 may be complied with.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking first respondent to look into the grievance of the petitioner and pass appropriate order in accordance with law and try to comply the order dated 28.2.2011 in case there is no other impediment in this regard but certainly after giving opportunity to the parties concerned.
