This application under section 482 Cr.P.C. has been filed by applicant Smt. Nirmala Devi, who is the complainant in Complaint Case No. 2882 of 2006 (Nirmala Devi Vs. Shyam Lal and others), under Sections 147, 323. 504. 506, 427, 452 I.P.C., P.S. Cantt., District Varanasi, has invoked the inherent jurisdiction of this Court, is for a direction to the court below i.e. Judicial Magistrate III, Varanasi, where the aforesaid case is pending, to decide the same expeditiously within a time bound period.
Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the records.
Learned counsel for the applicant argued that this case is pending since 2006 and N.B.W. is in operation against accused for the last three years but the same is not being proceeded, hence above relief has been prayed for.
Learned AGA is having no objection.
Expeditious disposal of his case is the right of every litigant and it is expected from every court to endeavour to dispose of a case pending before it, as expeditiously as possible, without granting unnecessary adjournment to any of the parties. Therefore, the trial court is directed to make all possible efforts to decide the aforesaid case as expeditiously as possible without giving any unnecessary adjournment to either of the parties.
With the aforesaid direction, this application is finally disposed of.
