Sri D.S. Yadav, learned counsel for the petitioner and Sri Girish Vishwakarma, learned Standing Counsel for the State.
Counsel for the petitioner submits that respondent no. 1, Naib Tehsildar (South), Phoolpur, Prayagraj be directed to decide the Case No. 1019 of 2014 filed under Section 34 of the Land Revenue Act in respect of Arazi No. 603 M area 0.1110 Hect, Arazi No. 622 M area 0.1290 Hect and Arazi No. 632 M area 0.1200 Hect situated in village Chhibaiya, Pargana Jhunsi, Tehsil Phoolpur, District Prayagraj, within a stipulate time.
This prayer is not opposed by the learned Standing counsel.
In view of such facts, the writ petition can be disposed of with a direction to respondent no. 1 to decide the aforesaid case of the petitioner on its own merits, if possible, within a period of 90 days from the date of receipt of computer generated copy of the order being passed today in PDF form strictly in accordance with law.
In above terms, the writ petition is disposed of.
It is made clear that this Court has not expressed any opinion on the merits of the case.
