Heard Sri C.S. Agnihotri, Advocate holding brief of Sri Ashok Gupta, the counsel for the petitioner.
The present writ petition has been filed against the order dated 11.3.2019 passed by the Consolidation Officer in proceedings under Rule 109-A(1) of the Uttar Pradesh Consolidation of Holdings Rules, 1954.
It appears that there is some dispute regarding the title of the petitioner over the disputed plots and the dispute had been decided against the petitioner by the Settlement Officer of Consolidation in an appeal filed under Section 11 of the Uttar Pradesh Consolidation of Holdings Act, 1953 (hereinafter referred to as, 'Act, 1953') and the revision filed by the petitioner under Section 48 of the Act, 1953 is still pending before the Deputy Director of Consolidation. In view of the aforesaid, it is not a fit case for interference by this Court under Article 226 of the Constitution of India, at this stage.
However, in the interest of justice, the Deputy Director of Consolidation, Banda, i.e., respondent no. 1 is directed to decide Revision No. 150 of 2019 pending before him within a period of six months from the date a certified copy of this order is produced before him.
The order dated 11.3.2019 passed by the Consolidation Officer shall be subject to the decision passed by the Deputy Director of Consolidation.
With the aforesaid direction, the writ petition is disposed of.
