JUDGMENT / ORDER

Petition filed under Section 439 Cr.P.C. 2. Petitioner is the first accused in Crime No.401/2014 of Pathanamthitta Police Station registered for the offences punishable under Sections 341, 294(b), 324, 427 and 307 read with Section 34 of the Indian Penal Code.
3. The allegation against the petitioner is that on 5.3.2014 at 6.30 p.m., he along with the second accused, obstructed the Skoda car, being driven by the de-facto complainant on the road and thereafter, they smashed and destroyed all the glasses of the car and dragged down the de-facto complainant. It is alleged that the petitioner indiscriminately inflicted a series of cut injuries on the de-facto complainant with a sword, thereby attempting to commit the murder of the de-facto complainant. By smashing and B.A.8479 of 2014 2 destroying the glasses of the car, they had caused a wrongful loss of ₹50,000/- to the de-facto complainant. The petitioner has been in custody for the period from 6.10.2014 onwards.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor. Over and above the present case, the petitioner is involved in 9 other crimes namely, Crime Nos.947/2008, 834/2009, 990/2009, 1134/2009, 27/2010, 249/2011, 310/2011, 588/2013 and 1167/2013 of the Pathanamthitta Police Station. It seems that the petitioner is a dare criminal and a habitual offender. Considering the series of serious criminal antecedents on his part and the facts and circumstances of this case, I am satisfied that the petitioner is not entitled to be enlarged on bail.
In the result, this bail application is dismissed.
