Counsel for Applicant :- Gaytri Rajput,Ashok Kumar Yadav,Indra Pal Singh Rajpoot Counsel for Opposite Party :- G.A.
Hon'ble Rahul Chaturvedi,J.
Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 199 of 2018, under Section 306 IPC, P.S. Jariya, District- Hamirpur is seeking enlargement on bail during the trial.
Learned counsel for the applicant in support of his application for bail submits that the applicant is innocent. He has been falsely implicated. It is further submitted that the FIR was got registered u/s 302 IPC against the husband, (brother-in-law) dewar and mother-in-law but after investigation the police has submitted a charge sheet u/s 306 IPC. As per the FIR version, after 8 years of marriage, there is a demand of Rs. 2 lakhs and on this account she has committed suicide, which is totally false and fabricated. It is further submitted that in the entire investigation there is nothing on record to show that at the point of time the applicant, who is the husband has abated the deceased to commit suicide. She died on account of burn injuries. It is further contended that it was a case of accidental burn which was given a colour dowry demand. It is next submitted that the applicant is in jail since 23.10.2018 having no criminal antecedents except the present one.
Learned AGA opposed the prayer for bail but could not dispute the aforesaid facts and the legal submissions as argued by the learned counsel for the applicant.
Keeping in view the nature of the offence, evidence, complicity of the accused, submissions of the learned counsel for the parties and without expressing any opinion on merits of the case, I am of the view that the applicant has made out a fit case for bail.
