JUDGMENT / ORDER

1. By preferring an application request is made to extend the period of temporary bail which is granted to the present applicant vide order dated 4th July 2012 in Criminal Misc. Application No. 9463 of 2012 (Coram : J.C Upadhyay,J.). Learned advocate appearing for the petitioner urges that due to unavoidable circumstances such operation could not be performed and the date is scheduled on 17th July 2012.
2. On having heard both the sides and considering the fact that no detail is provided as to why the surgery was not preferred, either in the application or certificate produced by the Doctor, this Court is of the opinion that already for the purpose of surgery he was allowed temporary bail for ten days and either the applicant ought to have surrendered or what reasons made it not possible for the Doctor to perform the surgery have to be stated in clear terms. This is a planned surgery and not as an emergency. This Court had earlier enlarged the accused on temporary bail for the said purpose. He could point out nothing to allow him. This application does not appear to be bonafide and therefore the same is dismissed.
