[1] Present application is filed by the under trial prisoner seeking temporary bail for a period of 30 days on the ground that his mother is required to undergo surgery. In this regard, certificate issued by Taraben Charitable Hospital is enclosed.
[2] On 15.05.2012, learned APP was asked to take instructions in the matter. Learned APP places on record communication dated 16.05.2012 received from the Office of Police Inspector, Naroda Police Station accompanied by statement of Hasmukhbhai Shah who has stated that said certificate was issued only advising further investigation in the matter and for taking treatment in specialized hospital.
[3] In view of above, no case is made out to grant any relief. Hence, the application is rejected. Rule discharged.
[4] At this juncture, learned advocate for the applicant requested to withdraw the application. The request is rejected.
