Rule.
Mr.Nanavati, learned APP appears and waives service of rule for respondent - State.
The instant application is filed in connection with Gandhinagar police station, Sector 21 C.R.No.-I-44 of 2009 seeking temporary bail for 15 days on account of surgery of wife of the applicant.
Having considered the submissions advanced by both the sides, so also considering the medical certificate annexed, stating that the surgery is scheduled on 5.7.2012, the application deserves to be granted in part.
The application is partly allowed and the applicant - accused is ordered to be released on temporary bail for a period of 10 days from the date of his actual release on his executing personal bond of Rs.10,000/- (Rupees Ten Thousand only) with one surety of the like amount to the satisfaction of the jail authority on the condition that the upon expiry of the temporary bail, the applicant shall immediately surrender to the concerned jail authority.
Rule is made absolute to the aforesaid extent. D.S.P.
