Heard Sri B.K.Mishra, learned counsel for the applicant, Sri I.P.Srivastava, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case with malafide intention.He further submits that PW1 has turned hostile before the trial Court. The applicant is in jail since 3.8.2015.
Learned AGA opposed the prayer for bail and submitted that the trial is in progress, but he could not dispute the aforesaid fact as argued by learned counsel for the applicant.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant-Nirbhai Yadav involved in Case Crime No.363 of 2015, under Sections 498-A, 304-B I.P.C. and Section 3/4 D.P. Act, Police Station Rampur Karkhana, District Deoria.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same preferably within a period of four months from the date of production of a certified copy of this order, if, there is no legal impediment.
Applicant is directed to produce a certified copy of this order before the trial Court concerned for its compliance.
